Misdemeanor Records

Misdemeanor records reflect actions that are deemed less than crimes by the courts, though this is often a matter of degree. What passes as a misdemeanor in one state may qualify as a crime in another. It's a well-known (and oft-cited) axiom that community standards vary, and hence it's up to each population to establish its own local laws to supplement those of the states' and nation's Constitutions.

While misdemeanor records are still qualitatively less serious than felony records, the former offenses are still punishable by incarceration in some cases. Typically, the term of jail sentences for misdemeanors rarely exceeds one year, while fines are generally capped at 500 or 1,000 dollars. Again, these are just general guidelines; some states do in fact issue five-to-seven-year jail sentences for "gross" misdemeanors.

What Do Misdemeanor Records Uncover?

Most states have sliding scales of misdemeanors that cover class A, B, and C infractions. Class As include more serious transgressions such as attempted arson, assault, and certain forms of theft. The next rung down in severity includes offenses such as DUIs and DWIs as well as driving without a license. Class Cs, which often aren't even covered by misdemeanor records checks, consist of "petty" offenses such as disorderly conduct or lewd behavior.

As an employer, you must decide whether more harmless infractions even register on your radar. It's hard to hold employees to an unreasonable standard of conduct throughout their histories, which include years of so-called "youthful indiscretions." Before proceeding on your witch hunt, it's wise to reflect on what, in your estimation, should legitimately disqualify an applicant from holding a job with your company.
