Usually, choosing a criminal defense attorney is a process conducted in as much haste as possible. Organizing legal defense nearly always means that there is some kind of emergency situation, and either you or someone you love could be sitting in prison. This urgency sometimes leads to bad choices. Like most things in life, choosing a criminal defense attorney requires careful thought and deliberation.

Most of us assume that members of the legal profession all have spotless reputations and can always be trusted. Sadly, this is not always true. You can get a crooked defense attorney just the same as you can find anyone in any other profession who is not above reproach. Since your liberty and your reputation may be at stake, it is most important that you find an attorney who is highly qualified, sufficiently experienced and totally trustworthy.

Don't Fall for Empty Promises

Never fall for a defense attorney who promises you that he will "get you off." No attorney worth his salt would make such a prediction. A trial depends on so many factors. While he may be able to tell you how the legal process is likely to proceed, you should always be aware of the uncertainty of the outcome.

Also, never fall for a defense attorney who tells you that if you pay a little extra "up front," that you'll be assured of a particular outcome. Getting involved with members of the legal profession who pay or accept bribes will only jeopardize your case should these facts become known. Depending on due process is your best option, always.

Even if a certain lawyer has been practicing in a certain way for years without being exposed, how can you be certain that the FBI won't catch up with him on your case? If this were to happen, it would have disastrous consequences and you could find yourself being defended against more than one criminal charge. This is a potential problem you don't need right now.

Get the Right Man for the Job

At the outset, it's important to make clear to everyone you talk to that you're looking for a criminal attorney. You don't want to end up with a defense attorney who is trying his first criminal case. You need someone who is au fait with criminal law so that you can be confident that everything that can be done is being done to help you.

If possible, find an attorney who has experience in exactly the kind of charges you now face. Try to look at some of the previous cases that your chosen attorney has worked on, and see how many he won. If you're about to choose an attorney who worked on a high profile criminal case you read about in the newspaper, pick the one who won.

Get a Local Lawyer

Think very carefully before you bring in a lawyer from out of town. A local lawyer is more likely to be familiar with the judge. An attorney who knows how a judge will react to certain lines of questioning and various court procedures will give the client the edge every time. This is not possible if the attorney is working in the courtroom for the very first time.

Lastly, it's important to pick a criminal attorney that you feel personally comfortable with. You may be seeing a lot of this person, so it's important that there is a level of mutual respect, if not a mutual liking. You need to be able to feel that you can count on this person, because your very freedom may depend on them and their professional and personal skills.
