Company Formation

Company formation signifies more than simply getting a group of partners together or coming up with a market sector on which to focus. While numerous meetings and planning sessions may constitute company formation in the unofficial sense, getting a company off the ground in an official manner requires paperwork that can't be done on a cocktail napkin. Company formation is often used as a euphemism for incorporating, as becoming a corporation is a monumental step in the operation of a successful company.

Incorporating is not a terribly challenging process, but it should be done with care nonetheless. Procedures common to incorporation including applying for a Federal Tax ID Number (also known as an EIN) and coming up with a unique name for one's company. The name of a company must not be a duplicate of another company's name or be too similar to the name of another business.

Incorporating can be completed quickly and easily when one works with a registered agent. Many companies look to incorporate in Delaware due to the favorable tax situation in state. The services of a registered agent must be employed when incorporating in Delaware.
