If you want to migrate to Australia as part of a visa program, you should know the basic requirements and restrictions. For instance, if you're applying for a partner visa, you'll only qualify if you are married or in a de facto permanent relationship with an Australian or a New Zealand citizen. In order to qualify as a partner, you must meet stringent conditions.

First of all, your partner must sponsor you. If you claim to be married or partnered with an Australian resident, and he or she declines to assist you for whatever reason, your application will be rejected. Second of all, you must have been in your permanent relationship for at least a year prior to applying. While this time frame may seem arbitrary, immigration services set up this bureaucratic roadblock to discourage capricious migration.

In addition, you and your spouse must both be at least 18 years of age. That said, there are certain extenuating circumstances to this role. If you're under 18 but believe you qualify as eligible for a partner visa, contact an immigration official to gauge your status.

Finally, Australian immigration law states that partners must be in a committed and "loving" relationship. While there aren't any hard and fast metrics that immigration officials use to evaluate relationships based on their "lovingness," you may be required to provide some proof of courtship. Given the difficulties associated with evaluating partner visa applications, the immigration service usually errs on the side of being lenient, although recent moves by the immigration bureau suggest that this trend may be changing.
