Drunk Driving DefenseFor a person who has been charged with driving under the influence of alcohol, it may seem impossible to refute the charge. We live in a nation that is obsessed with finding drunk drivers and punishing them. In reality, however, there are many ways to defend an individual who faces a drunk driving charge. According to attorneys, one of the easiest ways to defend a drunk driving case is by challenging the breathalyzer test that was performed at the time of the arrest. In many police stations, the breathalyzer that is used is old and inaccurate. A good defense attorney can bring into the courtroom the fact that a blood test is truly the only accurate method to determine blood alcohol level. Another defense that is often used by experienced attorneys is to challenge the evidence provided by police officers. In most cases, the so-called evidence from police officers is really just opinion. They can say that a person appeared to be drunk or had bloodshot eyes. The problem with this is that those statements are not scientific. What appears to be drunk to one person may not appear that way to another. In addition, there are a host of other medical conditions that can also result in bloodshot eyes. Red eyes can be caused by allergies or simply having itchy eyes. In addition, people who wear contacts frequently have red eyes due to dirty contact lenses or other problems. The fact is that an experienced DUI attorney can attack a drunk driving charge from a variety of angles. ![]() Get all Lawyers articles via
