Advance Settlement Funding

by Shirley Parker

Advance payment of expected settlement amounts can literally be a lifesaver to a personal injury victim, regardless of the scope of the accident. Settlement, in or out of court, can drag on for months, even with the best of law firms representing the injured party. A distraught victim may have to deal with the breakup of his family, as well as the loss of his job, home, car or truck, on top of losing his normal enjoyment of life.

Sadly, collection agencies are known for anything but courtesy and compassion when they demand payment from people who have no money through little or no fault of their own. However, collection agency employees are required to obey the law and not call at unreasonable hours, for example. The injury victim's law firm will usually step in and block collection attempts when their client is being harassed.

In spite of these pressures, injury victims should approach acceptance of advance settlement funding with great caution. The law firm they have retained to represent them is permitted to provide the names and addresses of companies that might provide advance payment, after all other sources of help have been exhausted. However, lawyers cannot give advice prior to an agreement being drawn up, in most cases.

This leaves an injury victim with the responsibility of reading the fine print and conducting his own research among the available sources. With due diligence, advance settlement funding can help those engaged in lengthy lawsuits to maintain their quality of life while pursuing a case.
