Lawsuit Cash Advances

by Shirley Parker

Personal injury claims can be settled quickly, but many take a long time, that is, more than a year or two years to reach settlement. Some employers, or their insurance adjustors, deliberately try to force settlement for a lower amount by dragging out the time for payment of a legitimate claim far longer than is necessary. Some reasons for sitting on a claim include making sure the person is really injured (or suffering from an illness contracted at work), and unable to perform his regular duties. In these situations, lawsuit cash advances may become necessary for the victim to pay for representation, or to simply pay everyday bills.

Fortunately, the fact that a sufficient amount of time has gone by for the injury to begin healing does not mean the claimant is no longer entitled to compensation for his injuries. It often takes instigation of a lawsuit to light a fire under the insurance company or government agency, and make them pay up. Sometimes, getting the victim a timely "day in court," whether in front of a jury or an Administrative Law Judge, is the only way to obtain the settlement amount that is due to him or his survivors.

In the meantime, the employer may insist the employee is needed back on the job. This is sometimes done in an attempt to both disprove the injury and to prevent the employer's insurance premiums from increasing. Often, though, employers insist that an employee stay out of the workplace, to avoid further injury--and further lawsuits.

In these situations, it is no wonder that cash lawsuit pre-settlement is often needed and considered. Though cash advances should not be taken lightly, a growing number of plaintiffs are finding them financially necessary to pursue their claims.
