California Drunk Driving Attorneys

by Kathleen Gagne

A law enforcement officer who stated that she observed you driving erratically down the center of a street stopped you. You may have been asked to complete a sobriety test at the site, or you may have been asked to take a Breathalyzer test. In any case, you had to surrender your driver's license in exchange for a Department of Motor Vehicles (DMV) "temporary" 30-day driving privilege.

This DMV Notice of Suspension is a two-sided document that formally suspends your license and explains some of your rights. It is critical that you read this entire document and pay close attention to your right to an administrative hearing if you want to contest the suspension. The most important piece of information is that you, or your attorney, have exactly 10 days from the incident to contact the DMV's local Drivers Safety Office to request the hearing.

Get an Attorney Fast

No matter what your personal opinion is about your DUI suspension, it is imperative that you get a qualified California DUI attorney to represent you as soon as possible. Your future and your driving privileges are on the line. If you or your attorney do not contact the Drivers Safety Office in time, your license will be suspended. Because DUI laws throughout the United States are so complicated and, in California, will involve you with both the DMV and the criminal justice system, it is almost impossible for you to represent yourself.

Note that, if the DUI suspension was related to an accident with injuries or death, you should not make any statement until you have contacted an attorney. This factor is not an admission of guilt; it is your right no matter what the circumstances. In California, you can find a DUI attorney who specializes in DUI cases. Not all persons who are accused of driving under the influence are guilty, and an expert DUI attorney will be able to analyze the police reports and evidence in order to make a case for a reduction of charges or even dismissal.
