California DUI FinesIn addition to the issue of potentially having a criminal record to deal with, those who are arrested for drunk driving (DUI) offenses are also faced with substantial monetary issues. For example, in California, for a first-time offender, fees and fines alone can range from $1,400 to $1,800. Costs will be higher when the accused obtains legal counsel, and those costs will depend on the attorney hired. The above amounts are based on an arrest with no aggravating factors such as speeding, causing an accident, or driving on an already-restricted license. Any of these added elements will increase any fines and other penalties. Driving under the influence with a child under 14 in the vehicle will also increase the costs. Fortunately, California allows for full payment of the fines within 45 days or payment over time with an additional charge. Working It OffCalifornia law also requires that all first-time offenders spend a minimum of 48 hours in jail. It may be possible for the accused to do community service in lieu of jail time if there were no added factors. In addition, some counties will allow the party to do community service to repay the major court costs. Having a DUI attorney during this process can make a significant difference. It should also be noted that California has a lengthy period of time in which DUI convictions stay on a person's record. Any conviction within the previous 10 years will be counted. Previous convictions will add to the severity of both the fines and penalties. Other miscellaneous costs that will very likely be imposed are DUI school costs and the increased cost for car insurance when the process is all over. In general, a DUI arrest will result in thousands of dollars out of pocket for the accused, no matter what the result. ![]() Get all California Lawyers articles via
