Union Petitions

Union petitions are filed with the NLRB (National Labor Relations Board) for two major reasons. The first represents a request for union representation. The second is a request to renounce current union representation.

As stated above, petitions filed with the NLRB either request union representation or renounce it. In order, however, for a petition to be taken into consideration by the NLRB, evidence of support must be demonstrated. An RC petition, for instance, should be accompanied by evidence that demonstrates at least 30% of the employees are interested in union representation.

Persons other than employees have the ability to file union petitions. Both employers and unions have the right to request union elections. Most employers tend to file petitions for RD rather than RC elections.

Time is yet another factor to consider. RC petitions can be filed at any time. RD petitions, on the other hand, must meet a variety of time requirements.
