Criminal Records SearchA criminal records search includes a history of criminal convictions along with all relevant personal information that can be used to qualify a candidate for a job, apartment or any other agreement with a another party. If you are concerned about the types of information included in your background check, rest assured. The following items are not considered public record. What Is Not Included in a Criminal Records Search?A workers compensation claim is a matter of public record after it has been processed through the Workers Compensation Appeals Board (WCAB). Employers can not use this information to deny you a position unless the claim reflects a problem that may hinder you from doing your job. For example, if you filed a claim about hurting your back after lifting heavy objects on the job, but applied for another position of similar nature, that employer may not hire you as your are prone to back injury. Additionally, bankruptcy filings are also available to public. The only case in which they wouldn't be accessible is after ten years of the initial filing. You can not be passed up for a position based on this information after the statue of limitations is up. Prior ArrestsAs mentioned previously, any prior history of arrest will not come up on criminal records search if you were never convicted of a crime. Unless the position you are applying for falls into the category of public utilities, security, child care and law enforcement, that information is considered private and can't be accessed by the public.
