Litigation capital is necessary to pursue a court case. The American legal system is clogged with superfluous cases, which is shocking when you consider how expensive it is to take anyone to court. It can cost tens of thousands of dollars, and can easily run well over that. You have to make sure going to court is worth it.


Litigation Capital Works

If you want to lodge a complaint against anyone within the legal system, you will need litigation capital. That is, money to hire a lawyer and pay other legal fees to pursue your case. This can be expensive. If you feel you have a strong case, a case that can be won, yet you have no money with which to pursue it, you may be eligible for legal funding.

There are companies that provide litigation capital for people who have exhausted all other avenues of income, have no money with which to lodge a legal complaint, but have a sound case. The legal funding is a bit like a bond. The company making the loan is essentially betting that you will win. That is why it's a very good sign if you are awarded this type of loan. The company believes you can win.


Pay if You Win

The best part of being lent legal funding is that you only pay it back if you win. It is repaid directly from your settlement. For the borrower, it is a win-win situation. For the lender, it can be bad news. If the case is lost, it's simply a wash for the company. For this reason, they scrutinize their cases forward and backward before advancing money.
